North Carolina Workers’ Compensation Program
 
Workers’ Compensation is a state-required insurance program required for employers with three or more employees to compensate employees who are injured or who get ill from work-related incidents.  Workers’ Compensation pays for medical costs and lost wages resulting from a work-related injury or illness regardless of fault.  There are strict time limits for filing Worker’s Compensation claims and rules regarding who is eligible for benefits.
 
If you or a family member is injured at work or on the job, be sure to get medical treatment for your injury.  Tell your employer immediately about your injury, and notify your employer in writing within thirty days after the injury.  If your doctor diagnoses you with an occupational disease, you must inform your employer in writing within thirty days of the diagnosis.  Make sure to keep a copy of your written notification to your employer.
 
You must also file a claim with the Industrial Commission to protect your right to benefits.  Usually this means filing an Industrial Commission Form, called a Form 18, within two years of your date of injury.  It is not enough that your employer files an employer's statement of injury, otherwise known as a Form 19.  When you file a Form 18, you should also give a copy to your employer.

  • You are not sure if you have a Workers’ Compensation claim or not
